Stuart Air Show Ticket Policy

A ticket purchased to the Stuart Air Show is a revocable license, which may be withdrawn and admission refused anytime. If admission is refused or this ticket license revoked due to misconduct of the licensee, then no refund or exchange will be given. Tickets cannot be re-sold or duplicated.  Holder shall not transmit or aid in transmitting any description, account, picture or reproduction of the event to which this ticket is issued.  Holder expressly grants the promoter and its licensees to use holder's image or likeness in connection with any live or recorded transmission or reproduction of such event. 

Access to venue by any person other than the original purchaser of this ticket may be denied.  Management may revoke the license and eject or refuse entry to the holder for violation of facilities rules, illegal activity or misconduct. Persons selling or reselling tickets in violation of any applicable city, county or state regulations, ordinances or laws are subject to arrest and prosecution.

EVENT DATE, TIME AND ARTISTS SUBJECT TO CHANGE.  RAIN OR SHINE.

TERMS & CONDITIONS

BILLING INFORMATION VERIFICATION: Ticket orders and other transactions are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or account information for a ticket order that can delay processing and delivery. If so, Customer Service will attempt to contact you, using the information provided at the time of purchase. If Customer Service is unable to reach you after its initial attempt, Customer Service may cancel your order and may sell your tickets to another customer without further notice.


UNLAWFUL RE-SALE OF TICKETS:  Unlawful resale of tickets (or attempted resale) is grounds for seizure and cancellation without compensation. A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by the Stuart Air Show. If such consent is obtained, any use of trademarks and other intellectual property is subject to the Stuart Air Show’s consent.


PERFORMERS/ACTS/SUBJECT TO CHANGE: Performers and Acts are subject to change or cancellation at any time without notice. No refund will be owed if any performer, act or any other scheduled performance, person or group is changed or cancelled and the event still occurs.


CANCELLED/POSTPONED EVENTS:  Occasionally, events are cancelled or postponed by the Stuart Air Show. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed event, please check the event information online or contact us.  


REFUNDS OR EXCHANGES: If a refund is issued, then we will most likely give you a refund by issuing a credit to the credit card that you used to purchase that ticket, and the holder of the ticket will not be able to physically present it for a refund. The ticket company’s customer service typically only offers refunds and/or exchanges based on the Stuart Air Show’s instructions. In order to receive a refund or an exchange that may be offered, you will have to comply with the Stuart Air Shows instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the Stuart Air Show’s discretion.


RAIN OR SHINE: Unless otherwise determined by the Stuart Air Show, all events are considered RAIN or SHINE. No refunds will be given due to inclement weather. 

LIMITATION OF LIABILITY: You expressly understand and agree that in no event shall the Stuart Air Show, including its affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether this site had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with: (a) the use, inability to use or performance of any of the services of this organization, or (b) any unauthorized access to or modification to any of your content or transmissions, or (c) any other matter relating to this organization or any of the services.
The ticket holder and event attendee voluntarily assumes all risk and danger of personal injury and disturbance and activities arising from or related in any way to the event whether occurring prior to, during or after the event. The Stuart Air Show follows updated CDC Health Guidelines. As such, you are required to follow venue rules and guidelines when attending the event. You may be denied entry, removed from the venue, or relocated without prior notice if staff deem you to be unsafe or high risk to any guest or team members.

Sponsor policies

1.  In consideration for being allowed to be a Sponsor at the Airshow, Sponsor waives, releases, and forever discharges the Stuart Air Show, its sponsors, producers, officers, directors, agents, insurers, employees, staff, officials, contractors, vendors, organizers, performers, volunteers, attendees, all other persons or entities involved with the Air Show, (collectively, the “Released Parties”), from any and all claims, causes of action, damages, losses (economic and non-economic), and liabilities of every kind (collectively “Claims”), including, but not limited to, releasing all of the above Released Parties from claims stemming from the Released Parties own negligence, for death, personal injury, or property damage, which may arise out of, result from, or relate to the Sponsor’s assistance/participation in, or traveling to or from, the Air Show, including, but not limited to, any Claims for theft, damage to any equipment, negligence, partial or permanent disability, Claims relating to the provision of first aid, medical care, medical treatment, or medical decisions (at any Air Show site or elsewhere), and any Claims for medical or hospital expenses. Sponsor assumes all responsibility for any and all risk of physical injury or death or property damage that it may sustain while participating in anyway, including travel en route to and from the Air Show, in any voluntary effort or activity of any nature, including the use of equipment and facilities of The Stuart Air Show. Furthermore, Sponsor agrees to indemnify and hold harmless and defend the additional named insureds, including the Stuart Air Show, Inc., Martin County Airport/Witham Field, all of their officers, directors, agents, employees, and volunteers, from any and all expenses incurred, claims made, or liabilities assessed against them, including but not limited to, attorneys’ fees and litigation expenses, arising out of or resulting from, directly or indirectly, in whole or in part, any breach or failure to abide by any part of this Agreement, any of Sponsor‘s alleged actions or inactions which cause injury, death or damage to any other person or property arising from any connection or nexus to Sponsor attractions or operations. Sponsor agrees that the venue for any action stemming from this agreement will only be in Martin County, Florida and this Agreement shall be governed by the laws of the State of Florida with attorney’s fees being awarded to the prevailing party. Also, if any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.  The Stuart Air Show follows updated CDC Health Guidelines. As such, you are required to follow venue rules and guidelines when attending the event. You may be denied entry, removed from the venue, or relocated without prior notice if staff deem you to be unsafe or high risk to any guest or team members.   

2.  Sponsor acknowledges and agrees to allow any photograph, video, likeness and/or voice to appear in any documentary, promotional (including advertisements), television, radio, electronic or film coverage of the Air Show without compensation or further notice, and agrees and assigns all copyright or other interests therein to The Stuart Air Show.  

3.  Neither the Stuart Air Show, Inc. nor its officers, agents, employees or representatives, or volunteers shall be liable or responsible for any delays or cancellations beyond its reasonable control such as  acts  of  God,  weather  delays  or  government restrictions.  

4.  No pets or animals allowed on the Air Show grounds.  ADA Service dogs are permitted. (See FAQ page for more info)

5. Banners are to be supplied by the sponsor. Recommended banner size is 6’x4’ on 13 oz scrim with metal grommets in each corner. 

For sponsors whose benefits include an exhibitor booth, please refer to the Exhibitor policies below. 

Exhibitor policies

Neither the Stuart Air Show, Inc. nor its officers, agents, employees or representatives, or volunteers shall be liable or responsible for any delays or cancellations beyond its reasonable control such as acts of God, weather delays or government restrictions.

3.  Neither the Stuart Air Show, Inc. nor its officers, agents, employees or representatives, or volunteers shall be liable or responsible for any delays or cancellations beyond its reasonable control such as  acts  of  God,  weather  delays  or  government restrictions.  

4.  Vendor shall not assign to a third party its rights hereunder or hire or use any subcontractors without the prior written consent of the Stuart Air Show, which it may withhold at its sole discretion. If such consent is given, the Vendor shall assume full responsibility for the conduct of the assignee/subcontractor and all its representatives, and the Vendor shall not charge its assignee/subcontractor more than a proportionate share of the amounts agreed to under this Agreement. Also, all assignees and subcontractors shall comply with all the duties and terms of this Agreement, including, but not limited to, the terms of insurance and indemnification.  

5.  Stuart Air Show will establish hours when the Vendor may enter the Show premises in order to setup, operate or take down the attractions, will establish assigned attraction and parking areas and reserves the right to make changes, including changes to the Vendor  areas so they do not conflict with the Airshow operations. However, such changes will be made as far in advance of the Air Show as possible. Stuart Air Show has the right without penalty to enter the booth or to deny entrance to the show and/or booth to anyone because of their conduct, noncompliance with the aforementioned designated hours, or for life, health or safety reasons and for the best interests of the Air Show.  

6.  No pets or animals allowed on the Air Show grounds.  ADA Service dogs are permitted. (See FAQ page for more info)

7.   All booths come with a complimentary 10x10 tent/booth set up that includes one 8’ table and two chairs.  These booths are set up using 75 lb weights on each corner in order to withstand high winds.  If you choose to use your own branded tent/booth, Stuart Air Show will not be responsible for any damages.  No electricity is available at the airfield.  Generators with a noise level of 70 decibels or less are permitted.  TWO Certificate of Liability Insurance documents naming 1) Stuart Air Show, Inc. AND 2) Martin County Airport as Certificate Holders must be provided.  Sample COL’s are provided to help you with this requirement.
